Terms and Conditions (T&C) for www.trustcheck21.com
1. Scope and Applicability These Terms and Conditions (“T&C”) apply to all users who access, register for, or use the services provided by www.trustcheck21.com (hereinafter referred to as the "Platform"), a service operated and owned by TrustCheck21 ("the Provider"). These T&C govern the rights and obligations of all users, whether natural or legal persons, in connection with the access to and use of all features, functions, content, and tools offered on the Platform.
These T&C apply regardless of whether the Platform is accessed via desktop, mobile device, application, API, or any other technical interface, and include both free and paid services. Additional terms may apply to specific premium or business functionalities, which will be communicated accordingly.
2. Services Offered and Functional Scope The Platform is an online trust and fraud assessment service that offers various tools and resources for analyzing, evaluating, reporting, and sharing information about the trustworthiness of websites, companies, online services, digital products, and platforms. The core services include, but are not limited to:
Access to a curated and continuously updated database of digital entities (e.g. websites, domains, platforms);
Provision of a Trust Score algorithm that combines technical analysis, user feedback, behavioral indicators, and metadata;
Enabling users to leave reviews, comments, and risk alerts on entries;
Options to report suspicious or fraudulent entities and request manual reviews;
Real-time scam alerts and notifications for registered users;
Access to downloadable reports and historical trust data (premium);
Business and Enterprise tools (e.g. API access, integration dashboards, automated monitoring);
Participation in affiliate and reseller programs.
The Provider reserves the right to enhance, suspend, or remove services at any time, provided such changes are reasonable and communicated in advance where possible.
3. User Registration, Account Management and Eligibility (1) Access to general content is available without registration. However, using interactive features (e.g., writing reviews, receiving alerts, saving searches) requires a user account. (2) Users must be at least 18 years of age and have full legal capacity to register. Legal entities must be represented by a duly authorized individual. (3) During registration, users must provide accurate, complete, and up-to-date information and must not impersonate another person or organization. (4) The user is responsible for securing their login credentials. Sharing credentials with third parties is prohibited. Any unauthorized use must be reported immediately. (5) The Provider reserves the right to suspend or delete accounts that violate these T&C, are inactive over extended periods, or are used abusively.
4. Use of Platform Content and Intellectual Property (1) All content published on the Platform, including reviews, Trust Scores, domain analysis, articles, data, logos, and software components, is protected by copyright, trademark, or database rights. It is the intellectual property of the Provider or licensed third parties. (2) Users are granted a limited, revocable, non-exclusive, and non-transferable right to use the Platform and its content for private, non-commercial purposes. (3) Commercial use (including use for audits, publications, risk assessments, or consulting) requires explicit written permission or a valid license. (4) Copying, scraping, redistributing, modifying, or framing Platform content without authorization is strictly prohibited.
5. User Content and Community Participation (1) Registered users may submit reviews, ratings, comments, and fraud reports. The user warrants that all submitted content is fact-based, truthful, and submitted in good faith. (2) The Provider does not endorse or guarantee the accuracy of user-submitted content. However, it may monitor, moderate, edit, or remove content that:
violates laws or third-party rights,
contains false or misleading information,
is defamatory, obscene, or offensive,
promotes scams or commercial advertising. (3) By submitting content, users grant the Provider a royalty-free, worldwide, perpetual license to display, modify, store, and distribute such content.
6. Prohibited Uses and Technical Restrictions Users are prohibited from:
uploading viruses or harmful code;
using bots or automation tools to access, scrape, or overload the Platform;
bypassing security features;
impersonating others or misrepresenting affiliations;
engaging in any form of abuse, harassment, or manipulation.
7. Data Privacy and User Information (1) The Provider collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and other relevant laws. (2) Users can find detailed information on the types of data collected, storage duration, usage purposes, and user rights in the Privacy Policy. (3) Appropriate security measures are in place to protect user data from loss, unauthorized access, and misuse.
8. Liability and Disclaimers (1) The Platform and its content are provided on an “as-is” and “as-available” basis. The Provider makes no warranties, either expressed or implied, about the accuracy, completeness, or usefulness of the data. (2) The Provider shall not be held liable for direct or indirect damages resulting from use of the Platform, unless caused intentionally or through gross negligence. (3) The Provider is not liable for the content or availability of linked external websites.
9. Licensing, APIs, and Paid Services (1) Premium features (e.g. API access, downloadable reports, enhanced analytics) may be subject to separate agreements and fees. (2) API access is granted only under licensing conditions and may be revoked for misuse or breach of agreement. (3) Resellers and affiliates must comply with specific guidelines, terms, and payout structures defined in the Affiliate Policy.
10. Duration, Termination, and Account Deletion (1) The user agreement is indefinite unless otherwise agreed. (2) Users may delete their accounts at any time via the account dashboard. (3) The Provider reserves the right to terminate accounts with 14 days' notice or immediately in case of serious violations.
11. Changes to Terms and Notification (1) These T&C may be updated or modified. Changes will be communicated by email or platform notifications. (2) If the user does not object within 14 days of notification, the changes will be considered accepted.
12. Governing Law and Dispute Resolution (1) These T&C are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules. (2) Where legally permitted, the place of jurisdiction is the registered office of the Provider. (3) Alternative dispute resolution mechanisms may be offered, including EU online dispute resolution platforms.
